Terms and Conditions: They’re about what you can expect and how we work…
Muddy Plimsolls Ltd (“Muddy Plimsolls”), a limited company (Companies House Registration number: 06492328) supplies a personal fitness training service (“the Service”). By purchase of a training plan (“Training Plan”) or other product from Muddy Plimsolls, you are agreeing to be bound by the following terms and conditions (“Terms of Service”).
Violation of these terms and conditions will result in immediate cancellation of your Training Plan. Muddy Plimsolls reserves the right to update and change these terms and conditions and that your continued use of the Service shall constitute your consent to any such changes.
Terms and conditions of your Training Plan
A Training Plan is a set number of personal training sessions taken over a set time period.
Payments and Refunds
A valid credit or debit card is required to sign up for a Training Plan or purchase individual sessions.
The date of your first scheduled training session is the first day of your Training Plan. We recommend you book and attend all of the sessions within the time frame of your Training Plan (usually 28-days – referred to as “monthly”, 84-days – referred to as “3 months” – or 168 days referred to as “6 months”). At the end of your current Training Plan, you will be contacted with regards to payment for your next Training Plan.
Payments for sessions that have been attended by you the client or those deemed to have had a “late cancellation” are non-refundable.
There will be no refunds or credits for partial periods of Service, nor refunds or credits for any unused personal fitness training sessions (“Sessions”) within a Training Plan, except under the terms of our guarantee (“Happiness Guarantee”) or exceptional circumstances.
Having completed the first Session of your first Service Period, if you are not satisfied with the Service you received, you may cancel your Training Plan under the Happiness Guarantee. You will be refunded your payment immediately, less a one-off fee of £62.50 for your first Session.
You can only claim under the Happiness Guarantee by emailing email@example.com within 24 hours of completing your first Session or before the start of your second Session, whichever is sooner. Muddy Plimsolls will email you to confirm receipt of your notification.
Muddy Plimsolls, in its sole discretion, has the right to amend or withdraw this promotion at any time without further notice.
Upgrading or Downgrading Your Next Training Plan
You may upgrade or downgrade your next Training Plan at any time by emailing: firstname.lastname@example.org. Muddy Plimsolls will email you to confirm receipt of your notification. You will be charged the new rate on the credit card or debit card that you provided when your next Training Plan period begins.
Freezing Your Training Plan
You may place your Training Plan on hold at any time by emailing: email@example.com. Muddy Plimsolls will email you to confirm receipt of your notification. No more payments will be taken. You may place your Training Plan on hold for a minimum of one month and a maximum of three months.
Cancelling Your Next Training Plan
You are solely responsible for properly cancelling your Training Plan.
If you do not wish to start a new Training Plan at the end of your current Training Plan, you can cancel by emailing: firstname.lastname@example.org. Muddy Plimsolls will email you to confirm receipt of your notification. You will not be charged for any subsequent Training Plans.
Muddy Plimsolls, in its sole discretion, has the right to suspend or terminate your Training Plan and refuse any and all current or future provision of the Service for any reason at any time.
Cancelling a Session
You may cancel or re-schedule the Sessions included within your Training Plan, up to 24 hours before the start of the Session. If you choose to cancel within 24 hours of the start of the Session, that Session will be deducted from your Training Plan allowance.
Your Session Balance
The number of Sessions included in your Training Plan (“Session Balance”), resets at the start of each new Training Plan period. Any unused Sessions at the end of any monthly Service Period, are invalidated and cannot be accumulated or credited to subsequent Service Periods.
Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis.
By checking the box ‘I have read the terms and conditions’ found on our New Client Registration form, yo agree that you have read and understood these terms and conditions and agree to be bound by them.
Training Plans are non-transferable.
Upgrades or downgrades of Training Plans are subject to availability of your preferred trainer or understanding that an alternative trainer will be offered.
Muddy Plimsolls does not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be supplied uninterrupted throughout any Service Period. Results cannot be guaranteed.
Should any of our personal trainers be unable to attend a booked session, Muddy Plimsolls reserves the right to arrange a replacement trainer to attend the session. Should any trainer be unavailable for bookings over a period longer than 7 days, Muddy Plimsolls will seek to offer an alternative trainer as cover. We cannot guarantee an alternative trainer will be available.
You understand that the failure of Muddy Plimsolls to exercise or enforce any right or permission with the Terms of Service shall not constitute a waiver of such rights or provision. The Terms of Service constitutes the entire agreement between you and Muddy Plimsolls and supercedes any prior agreements between you and Muddy Plimsolls.
